Patricia M. Berry focuses her practice on employment litigation and appellate advocacy. In her employment litigation practice, Ms. Berry has represented private and public employers in state and federal court, defending wrongful termination, discrimination, retaliation, and sexual harassment single-plaintiff and class action cases. Ms. Berry also has expertise in anti-SLAAP litigation.
In her post-trial and appellate practice, Ms. Berry recently won a new trial for the defendant university in Klein v. University of Southern California, a case in which a Los Angeles jury had awarded $2.5 million to the plaintiff. On the appellate level, Ms. Berry represented the employer in the case of Huffman v. Interstate Brands Corporation, 121 Cal. App. 4th 679 (2004), in which the Second Appellate District reversed the plaintiff’s jury verdict and remanded for new trial. Ms. Berry also has prepared amicus curiae briefs on behalf of the California Employment Law Council, and has defended appellate challenges to summary judgment and other dispositive motions. As an example, Ms. Berry prepared the appellate brief in the case of Jackson v. Microsoft, in which the United States Court of Appeal for the Ninth Circuit affirmed the district court's order imposing terminating sanctions against the plaintiff.
Ms. Berry counsels employers and speaks to various professional organizations, law firms, and in-house legal departments on a variety of employment-related topics. She is co-author of the chapter Multi-Plaintiff Litigation and Class Actions: A Defense Perspective which appears in the second edition of the book LITIGATING THE SEXUAL HARASSMENT CASE, published by the Torts and Insurance Practice Section of the American Bar Association.
Ms. Berry is a member of the State Bar of California and is admitted to practice before the United States Supreme Court. For the second consecutive year, Ms. Berry was named a California “Super Lawyer” in the area of employment and labor law as reported in Los Angeles Magazine.
Ms. Berry received her B.A. from the University of Redlands and a Master of Fine Arts from the University of Washington. She received her J.D. in 1990 from the University of Southern California. At USC, Ms. Berry was a member of the UNIVERSITY OF SOUTHERN CALIFORNIA LAW REVIEW and graduated Order of the Coif. |
